1. Scope of this policy
This Acceptable Use Policy sets out the behaviour that AI Smartual Learning Sdn Bhd ("VLearned", "we") requires from everyone who uses the VLearned platform, in any environment and for any module. It applies to learners, employees, instructors, trainers, tutors, publishers, reviewers, assessors, managers, administrators, parents and guardians, and to anyone who registers for an account or uses a public page on the platform.
This policy is part of the Terms and Conditions. Where an organisation has adopted additional rules for its own environment, those rules apply in addition to this policy, and where they are stricter they will be enforced for that environment. This policy does not restrict anything that the applicable law expressly permits and that cannot lawfully be restricted.
2. You must not break the law or infringe anyone's rights
You must not use the platform to:
- break any applicable law, regulation, court order or official direction;
- infringe copyright, trade marks, database rights, design rights, confidentiality, privacy, or any other right of another person;
- defame, harass, threaten, stalk or bully anyone;
- discriminate against anyone on any protected ground, or incite others to do so;
- exploit, sexualise, or endanger a child or any vulnerable person;
- distribute or publish material that is unlawful, fraudulent, defamatory, obscene, or that promotes violence, self-harm, terrorism or hatred;
- misrepresent your identity, your qualifications, your organisation, or the origin of content you publish; or
- mislead others about whether content is generated by a person or by an AI feature, where that distinction matters.
3. Content standards
You are responsible for everything you upload, publish, submit or post on the platform, and for anything you stream or make available through a live session. You must not upload or distribute content that:
- is unlawful, or infringes the rights of others, including content you do not own the rights to;
- is misleading, fabricated, or presented as fact when it is not — for example, invented statistics, fake qualifications, false testimonials, or content generated by an AI feature that has not been checked;
- contains malware, malicious code, or instructions intended to compromise a system or to harvest credentials;
- contains another person's personal data that you are not authorised to share, or that you obtained other than through a permitted feature such as a referral link;
- is spam, or is distributed in bulk for the purpose of promotion, in breach of the rules of the organisation you are acting for;
- advertises or promotes a product or service in a way that is false, deceptive, or unlawful, including fake reviews or fake scarcity;
- impersonates another person, organisation or brand, or misuses a logo or trade mark; or
- is discriminatory, exploitative, or designed to harass.
Where you publish content on a public page or in a public marketplace listing, you are also responsible for making sure that the content you publish is yours to publish, that it is described accurately, and that the pricing and availability you state match what you actually deliver.
4. Security and technical misuse
You must not:
- attempt to gain unauthorised access to any account, record, workspace, system, network or connected service, or to any other person's data;
- use another person's credentials, or ask another person to use yours;
- bypass, disable or interfere with access controls, permissions, role boundaries, organisation scoping, rate limits, assessment rules, usage limits, subscription limits, or any security mechanism;
- probe, scan, stress-test, flood, disrupt, overload or degrade the platform or any connected service, or interfere with other users' access to it;
- upload or transmit malware, or code intended to damage a system, steal credentials, intercept communications, or read data without permission;
- reverse engineer, decompile or attempt to extract source code or proprietary materials from the platform, except to the extent that this is expressly permitted by law and cannot be excluded by contract;
- scrape, harvest or bulk-collect personal data, or use automated means to access the platform, other than where a published API or written authorisation allows it;
- frame or embed the platform in a way that misrepresents who operates it, or that alters its appearance without written permission;
- evade a lawful restriction, suspension, or security measure; or
- use the platform to build, train or evaluate a machine-learning model, or to generate content for training, without our prior written permission.
5. Learning, assessment and credential integrity
The platform issues grades, certificates, progress records and digital identity cards. For those records to mean anything, the following apply to every learner and every employee:
- do not access restricted assessment materials, question banks, answer keys or marking schemes without authorisation;
- do not share questions, answers, marks, answer keys or assessment content in breach of the assessment rules that apply to you;
- do not submit work you did not author as your own, and do not submit work on another person's behalf, where the applicable rules prohibit it;
- do not interfere with assessment timing, attempt limits, proctoring, grading or integrity controls;
- do not falsify, edit or request the falsification of attendance, submissions, grades, progress records, certificates, identity cards, invoices, payment records or system logs; and
- do not use an account that has been issued to someone else, and do not let someone else use yours.
Instructors, assessors and organisation administrators are responsible for setting the assessment rules for their environment and for acting on any breach they find. Where a rule in this policy conflicts with the assessment rules an organisation has published, the organisation's rules apply for that assessment.
6. Marketplace and creator conduct
If you sell content or offer tutoring through the platform, you must:
- only list content you own or have permission to sell, and only offer services you are qualified and authorised to provide;
- describe your content, its price, its duration and what the learner will receive accurately, and not use fake urgency, false scarcity or misleading claims about credentials or outcomes;
- not leave fake reviews, or buy or exchange reviews;
- not collect a learner's payment details yourself outside the platform's checkout, and not ask a learner to pay you by an untraceable route;
- deliver what you have sold, or handle the learner's request through the platform's refund process; and
- comply with the tax, consumer-protection and professional rules that apply to you, which the platform does not determine for you.
Where a learner has a problem with content or a tutoring session, they should raise it with the organisation or creator first, and use the refund process described in the Terms and Conditions if it cannot be resolved.
7. Use of AI features
AI features on the platform are assistive. You must not:
- publish AI-generated material, or use it to grade or assess a learner, without reviewing it first for accuracy, fairness, accessibility and suitability;
- present AI-generated material as your own unaided work where the applicable rules require you to identify it as AI-assisted;
- use an AI feature to impersonate a person, to fabricate a qualification or reference, or to produce deceptive content; or
- submit personal data, confidential records, credentials or restricted assessment material to an AI feature unless your organisation has approved that use.
Providers of AI features must tell users that the output is AI-generated and may be inaccurate, and must keep that notice visible where the output is used.
8. Communications and communities
Forums, chat, comments, announcements and live sessions are shared spaces. You must not send threats, harassment, discriminatory abuse, malicious links, phishing content, spam, or unsolicited bulk communications, and you must not share another person's contact details, private messages or personal records without an appropriate basis and authorisation. Organisations are responsible for the lawfulness of the communications they send through the platform and for their own internal policies.
9. How we enforce this policy
When we believe this policy has been breached, or where an organisation reports a breach in its environment, we may take any step that is proportionate and permitted by the Terms and Conditions and the law. Depending on the seriousness of the breach and on who is affected, that may include:
- issuing a warning or a formal notice;
- removing or restricting content that is unlawful, infringing, deceptive or harmful, whether or not it was published deliberately;
- restricting or suspending a feature, an account, or access to a particular environment, temporarily or permanently;
- terminating an account or an organisation's access to the platform;
- withholding or reversing a creator's earnings where the breach affected a sale; and
- reporting the matter to a law enforcement, regulatory or other competent authority where the law requires or permits it.
Where it is reasonable and lawful to do so, we will tell you what has happened and why before restricting content, and we will tell the organisation administrator of an environment where a decision affects their users. Immediate action may be needed to protect users, data or systems, in which case the explanation may follow.
10. Review of decisions
If you believe a decision taken under this policy was wrong, or that your circumstances have changed, contact us through the details below, and copy your organisation administrator if your access is managed by an organisation. We will consider the request, and where a decision was taken by the organisation rather than by us, we will ask the organisation to review it. A review request does not guarantee a different outcome, and some decisions cannot be reversed where content has already been delivered, a certificate has already been issued, or a legal obligation requires us to act.
11. Reporting a breach
If you see content or conduct that breaches this policy, report it through the contact details below. Include the URL or a description of the content or activity, what you believe the problem is, and anything that helps us assess it. Please do not include sensitive personal data that is not needed. Reports of infringement of intellectual property rights are handled under the DMCA and Copyright Policy instead.
12. Changes to this policy
We may update this policy when the platform, the law or our moderation approach changes. Each published version shows its effective date, its last-updated date and a version number. Where a change is material, we will provide notice through the platform or by email.
